My key role is to authenticate and certify signatures and documents for use overseas. I will prepare, witness or certify documents going abroad. Often the document will have been prepared by a foreign lawyer. The documents include: powers of attorney, sworn statements, contracts, property papers and certificates of law.

Once a notary has applied its seal and signature to the document, the notary’s seal and signature may need to be authenticated and verified by the UK Foreign, Commonwealth and Development Office (“FCDO”). The FCDO will attach a certificate known as an “Apostille” to the document. An Apostille is recognised internationally pursuant to the Hague Convention. Certain countries may require the Apostille from the FCDO and a further certificate from their own UK embassy, high commission or consulate of the country in question. Legalisation requirements are determined only by the country where the document is going, not by the UK government.
If the document is going to a country that is or was part of the British Commonwealth then is usually does not require an Apostille. Equally documents going to many parts of the United States do not require legalisation.
The cost of obtaining an Apostille from the FCDO is £30 per document. An additional fee will be charged for courier costs and administration undertaken by the notary.
The nearest FCDO to the North East is Milton Keynes but a premium service is offered to business users only with a 24-hour turnaround in London at a cost of £75 per document (plus courier fees). I am not currently a business user so I will use an agent for urgent legalisation requirements.
